FlexiPlanner Terms of Service
1. Who We Are
FlexiPlanner is operated by Onur Senturk, an individual developer based in the Netherlands (“we”, “us”, “our”). For questions, use the in-app “Leave Feedback” channel. Email support is not provided.
2. Eligibility
You must be at least 16 years old and able to enter into a binding agreement. Do not use FlexiPlanner if prohibited by law in your jurisdiction.
3. Your Account
- You are responsible for keeping your login credentials secure.
- You are responsible for all activity under your account.
- We may suspend or terminate your account for misuse, legal risk, or violation of these Terms.
- You may not sell, transfer, or assign your account to anyone else.
4. Your Content
- You retain ownership of the tasks, notes, attachments, and other content you add to FlexiPlanner.
- You grant us a limited, worldwide license to store, process, and display your content only to operate, maintain, and improve the service features you use (e.g., syncing, reminders).
- Do not upload unlawful, harmful, offensive, or infringing content.
- FlexiPlanner is not a data backup service. We do not guarantee the retention or availability of your content. You should maintain your own backups.
5. Intellectual Property
All FlexiPlanner software, design, code, features, branding, and documentation are the property of the operator and may not be copied, modified, reverse-engineered, or redistributed without written permission.
6. Integrations
If you connect Google Tasks, you authorize FlexiPlanner to use the Google Tasks API scope to create and update your dedicated FlexiPlanner task list on your behalf. You may disconnect at any time; syncing will stop immediately. We are not responsible for outages, failures, changes, or limitations in Google’s services.
7. Acceptable Use
You may not:
- Attempt to disrupt, overload, or reverse engineer the service.
- Access data that is not yours or bypass access controls.
- Use FlexiPlanner for spam, abuse, harassment, or illegal activities.
- Use the service in high-risk contexts where errors may cause harm (e.g., medical reminders, emergency response, safety-critical operations).
- Use automated systems or bots without written permission.
8. Availability and Changes
FlexiPlanner is provided on an “as is” and “as available” basis. Features may change at any time, and we may suspend or discontinue the service at our discretion, including during development of new or experimental features.
9. Disclaimers — Use at Your Own Risk
Your use of FlexiPlanner is at your own discretion and risk. By using the service, you accept all risks associated with it, including loss of content, inaccurate data, missed reminders, or service interruptions.
No Professional Advice: FlexiPlanner provides organizational features only. It does not provide medical, legal, financial, or professional advice.
10. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
- We are not liable for loss of data, business, revenue, or opportunities arising from your use of the service.
- The total liability of the operator for any claim will not exceed the amount you paid for the service in the 12 months before the claim (or €0 if you use the free version).
- You agree that you cannot hold us liable for any damages resulting from your use of FlexiPlanner.
11. Indemnity
You agree to indemnify and hold the operator harmless from claims, damages, liabilities, and expenses arising from your misuse of the service, your content, or your violation of these Terms.
12. Data Protection
Your use of the service is also governed by the FlexiPlanner Privacy Policy. We do not sell your data or use it for advertising.
13. Termination
You may stop using FlexiPlanner at any time. We may suspend or terminate your access for violation of these Terms or legal risk. After termination, your right to use the service ends immediately, and your account may be deleted.
14. Changes to These Terms
We may update these Terms periodically. Material changes will be indicated with an updated date. Continued use of FlexiPlanner after changes means you accept the updated Terms.
15. Governing Law
These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles. Where permitted by law, disputes will be resolved exclusively in the courts of the Netherlands.
16. Severability
If any part of these Terms is found invalid or unenforceable, the remaining sections will remain in full effect.
17. Waiver
Failure to enforce any right or provision of these Terms does not constitute a waiver of that right.
18. Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and the operator regarding FlexiPlanner.
